TERMS AND CONDITIONS basics

The products sold on www.daimona.it (hereinafter referred to as the "site") are sold and invoiced by Daimona, based at via G.Leopardi, 20123, Milan (MI), a sole proprietorship registered with the Milan Chamber of Commerce under registration number REA 2529904, tax code/VAT number 06708350829. For any information regarding orders, shipments, and, more generally, purchases, you can contact Daimona customer care at the following email address: studio@daimona.it.

ACCEPTANCE OF TERMS AND CONDITIONS OF SALE AND CONCLUSION OF THE CONTRACT

1.1 The contract between Daimona and the customer (i.e., the individual person who makes a purchase on the site not related to their commercial, entrepreneurial, or professional activity) shall be considered concluded upon Daimona's acceptance, even partial, of the order. In the event that the order is not accepted, Daimona will promptly inform the customer.

1.2 By placing an order through the available methods, according to the order form on the site (hereinafter referred to as the "order"), the customer declares that they have reviewed all the information provided during the purchasing process and fully accepts these general terms and conditions (hereinafter referred to as the "terms").

1.3 These terms can be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Legislative Decree 70/2003 and Article 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

1.4 Daimona will refund the customer for the full amount paid, excluding shipping costs and any customs duties paid for importation, within 14 (fourteen) days from the cancellation date, transferring the charged amount using the same payment method used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not incur any costs resulting from the refund. Daimona may withhold the refund until the returned product is received.

PURCHASE METHODS

2.1 The products offered for sale by Daimona are solely those available on the Daimona website at the time of the order submission, as described in their respective product information sheets.

2.2 It is understood that the images accompanying the product description are for informational purposes only and may not perfectly represent the actual characteristics of the product, as they may differ, for example, in color and size (due to the browser and monitor used for accessing the site and viewing the images).

2.3 To place an order, the customer must complete the order form on the site in its entirety and submit it after carefully reviewing the terms and conditions, as well as the characteristics of the product(s) they wish to purchase. The customer must also request, if desired, the issuance of an invoice for the purchase, as per Article 22 of Presidential Decree No. 633/1972.

2.4 The correct receipt of the order is confirmed by Daimona via an email response sent to the email address provided by the customer. This confirmation message will briefly outline the purchase conditions, as required by applicable law, as well as the data entered by the customer in the order, allowing the customer to verify them and promptly communicate any necessary corrections of incorrect data.

PRICES AND PAYMENT METHODS

3.1 The prices listed on the site are inclusive of taxes and VAT. Any shipping costs or payment fees will be communicated to the customer in advance through the site or these terms and conditions.

3.2 The following payment methods are available:

  • PayPal: Customers can use PayPal for payment according to its specific procedures.

  • Credit Card: For purchases made with a credit card, the transaction may be processed through the secure PayPal server or another secure server chosen by Daimona. At no point during the payment process will Daimona have access to the customer's credit card information, which is transmitted via a secure connection directly to the bank managing the transaction. No Daimona database will store this information, and therefore, Daimona cannot be held responsible for any fraudulent or unauthorized use of credit cards by third parties during payment.

  • Bank Transfer (only for EU countries): If paying by bank transfer, the bank details will be displayed for payment. Shipment will occur only once the payment has been received by the bank.

  • Klarna: Klarna is an installment payment service that allows you to split the cost of your purchase on our site into 3 equal payments. Here you can find all the information about the installment payment option and how to use it online.

3.3 We reserve the right to not accept, cancel, or refund an order if, due to errors, bugs, or other issues, the price of the product listed on the site is mistakenly shown as significantly lower than the correct retail price. In any case, we will contact you to verify if you would still like to purchase the product at the correct price.

DELIVERY OF PRODUCTS AND RELATED COSTS

4.1 The products purchased will be delivered to the address provided by the customer in the order within 30 to 40 days from the acceptance of the order by Daimona, at the cost specifically indicated on the site before the order is submitted. Daimona reserves the right to accept or decline deliveries requested outside of Italy or Europe. In any case, for deliveries outside of Italy, shipping costs and delivery times may vary.

4.2 For deliveries to countries outside the European Union, any customs duties for import will be the responsibility of the recipient. Therefore, the customer is encouraged to contact the customs authorities of their country in advance to verify the costs and potential import restrictions.

4.3 The delivery times indicated by Daimona should be considered as purely indicative. A delay in delivery, or the delivery of items in separate shipments, does not entitle the customer to refuse delivery or request compensation or indemnification.

4.4 Upon delivery of the products, the customer is required to check:

  • That the number of packages delivered matches what is indicated in the shipping document.

  • That the packaging is intact, undamaged, not wet, or otherwise altered, including closure materials (adhesive tape or metal straps).

  • Any damage to the packaging and/or product, or discrepancies in the number of packages or their details, must be immediately reported by indicating this on the delivery document, which should then be returned to the courier.

  • Any issues concerning the physical integrity, correspondence, or completeness of the products received must be reported within 7 days of delivery, following the procedures outlined in this document.

RIGHT OF WITHDRAWAL

5.1 Pursuant to Article 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the customer may withdraw from the terms and, therefore, from the purchase contract for any reason, without the need to provide a justification and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.

5.2 To exercise the right of withdrawal as per the previous Article 5.1, the customer must send a communication to Daimona within the specified time frame at the following email address: studio@daimona.it, using the appropriate form available on the website. Registered users can access the "Returns" section of their user dashboard and manage return requests.

5.3 In the event of withdrawal, the customer must return the products to Daimona within 14 (fourteen) days from the withdrawal: for all packages, whether coming from EU countries or non-EU countries, the shipping address is as follows: Aurora Leopardi and/or Poste Italiane office, Via G. Carducci n.7, 20123 Milano (Ml) Italy. For acceptance by the post office, all packages must be marked with the word 'Fermoposta'. The merchandise must be returned intact, complete with all its parts and in the original packaging (bags and boxes), kept and possibly used only for the time strictly necessary to establish and verify its nature, characteristics, and size, with due care, without signs of wear or dirt, in compliance with the following conditions: the right of withdrawal applies to the entire product purchased. It is not possible to withdraw only part of the purchased product (e.g., accessories, complements, etc.). For withdrawal to be valid, the product must be intact and returned in its original packaging, complete with all parts (including packaging and any documentation and accessories: labels, tags, seals, etc.). The authenticity tag must remain attached, and the safety cord must be intact.

5.4 Daimona will refund the customer the full amount already paid, minus any additional shipping costs as per Article 56, paragraph 2, of Legislative Decree 21/14, within 14 (fourteen) days from withdrawal, through the cancellation of the charged amount, using the same payment method used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not incur any costs as a result of this refund. Daimona may suspend the refund until the returned product is received.

5.5 In any case, the customer will lose the right of withdrawal in the following cases:

  • If the returned product and/or its accessories and/or packaging are not intact.

  • If the product is missing its outer packaging and/or original internal packaging.

  • If the product is missing integral parts and/or accessories (e.g., closures, laces, buckles, etc.).

  • In the case of loss of the right of withdrawal, Daimona will return the purchased product to the sender, charging them the shipping costs, and, if already refunded, the price of the product.

GUARANTEES

6.1 All products sold by Daimona are covered by a 24 (twenty-four) month guarantee for conformity defects, pursuant to Title III of Legislative Decree 206/2005. To benefit from guarantee assistance, the customer must retain the invoice or payment receipt, along with the shipping document.

6.2 The guarantee for conformity defects applies provided the product has been used correctly, in accordance with its intended use and the care and usage instructions included with the product.

6.3 In the event that, for any reason, Daimona is unable to provide the customer with a guaranteed product (repaired or replaced), or if the repair or replacement is excessively costly, even considering the value of the product, Daimona may proceed with an appropriate reduction in the price paid, or provide a full refund of the amount paid, terminating the contract.

6.4 In cases where the application of the guarantee requires the return of the product, the customer must return it in its original packaging, complete with all its parts (including packaging, any documentation, and accessories).

Privacy

8.1 The personal data collected upon order submission will be processed by Daimona solely for the purpose of fulfilling the customer's express requests, in accordance with EU Regulation 2016/679 and the privacy policy available on the website. Any further processing will be carried out only with the express consent of the customer.

Applicable Law

9.1 The sales contract under these terms and conditions, and its execution, are governed by Italian law, with the exclusion of conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods. For the resolution of any related disputes, the competent court will be the one located in the customer's place of residence.

9.2 We would like to inform you that the European Commission provides a platform for the alternative out-of-court resolution of disputes, including cross-border disputes, accessible at the following website: http://ec.europa.eu/odr.
